Lolicon/shotacon are covered by a separate law than CP, one which uses a mostly subjective test to determine if something is "obscene". Eco does not want any legal liabilities, so he keeps loli/shotacon off just on the off chance that a landmark legal case, which would go all the way to the Supreme Court and end up finally defining how the Miller Test is applied to websites, is launched against Ponibooru. |

Additionally (dammit I want to be able to edit posts), it's Federal law (the rules page is just covering the most specific area, tho it really could use a wording that doesn't imply California has its own anti-loli/shotacon laws).
Technically, however, due to the way the Miller Test is applied, something completely illegal in one town is completely legal in other towns, and both of those may swap simply by selecting a different jury. Why? Because the Miller Test is positively stupid, as a natural result of being a way to say "if society hates this, people should be put in jail for it even if there are no victims." |
