It's not like the background ponies will even be named in-show, but I support the idea of Heartstrings being a last name for Lyra in fanon.
Generally though, I don't take the blind bags too seriously. I mean, they haven't even released them in the US aside from some Toys"R"Us box set (as far as I know) and they're all palette and mark swaps of molds of five of the Mane Six...and Big Macintosh as of this third set. I'm starting to think Fluttershy's getting screwed because it may be too challenging to replicate her hairstyle in a tiny plastic figurine without it being fragile. Or something like that. |

Corporations don't use fan material. If they do, sooner or later they have to decide who really owns it, and pay some fan for it. This stuff happens. If you want to be certain that a given idea or name is NEVER used by a corporation - then send them a letter telling them you'd like them to use it.
They can't use fan material without risking lawsuits. |

@Lancer: That's not the situation at all. Hasbro has a contractual agreement that they can (essentially) use the likeness of any character on the show.
Hasbro must obtain the rights to use a named character as a trademark if they didn't create it (i.e. Twilight Sparkle; covered in the contract between the show creators and Hasbro). Other names they inherited from previous toy lines and shows. HOWEVER... Hasbro doesn't trademark everything. Sure, the mane six names are trademarked. But Spike? Applebloom? Nope. They use those names on packaging and on products without attribution. Names of characters that do not belong to someone cannot be copyrighted (implictly or otherwise). Since Hasbro doesn't even need to seek trademark registration if they want to use a name to a character they own, there is no potential legal conflict. The only sticky situation is if a fanon name became trademarked by someone other than Hasbro. But that person would be a dick. And then Hasbro can challenge them in court if the trademark was intended for sale and distribution of toys. If it isn't, then Hasbro wouldn't even need to seek permission to use that name on blind bags or whatever because the markets don't overlap. Keep in mind that picking the ponies in the blind bag was probably not a decision anyone high up spent more than a few minutes on. For all we know some project manager threw darts at the Comic-con poster, typed some off the cuff names into an email along with some colors and packaging guidelines before sending it off to the manufacturing guys. Best case scenario is that he tested some names in a focus group (his kids, over the phone) and went with that. This person does not work closely with the Hub or the show. It is likely those responsible were unaware that fanon names even existed. |
